The Scottish Government has confirmed these regulations amend the existing Repairing Standard to require rented homes to be &#8220;substantially free from damp and mould,&#8221; backed by fixed statutory timescales similar in structure to England&#8217;s: broadly, an investigation within 10 working days of a landlord becoming aware of a report, a written summary of findings within 3 working days of the investigation concluding, and repair work starting within 5 working days where required.<\/p>\n<p><strong>The key difference from England:<\/strong> Scotland&#8217;s regulations are set to apply to <strong>both social and private rented tenancies from the start<\/strong>, rather than social housing only. This is a meaningfully broader scope than England&#8217;s phased approach.<\/p>\n<h2>Wales<\/h2>\n<p>Wales has not introduced an Awaab&#8217;s-Law-style framework with fixed statutory timescales equivalent to England&#8217;s or Scotland&#8217;s. Instead, Wales already has a distinct legal mechanism: the <strong>Fitness for Human Habitation (FFHH)<\/strong> standard under the Renting Homes (Wales) Act 2016, in force since 2022. This requires landlords to ensure a rented home is fit for human habitation throughout the tenancy, assessed against 29 defined &#8220;matters and circumstances&#8221; &mdash; damp and mould growth is explicitly &#8220;Matter 1&#8221; on that list.
